Website Terms of Use

These Website Terms of Use ("Terms") govern access to and use of the public Polytrace website, public forms, public content, and other public web pages operated by Polytrace Inc ("Polytrace", "we", "us", or "our").

Product subscriptions, trials, proof-of-concept deployments, data processing terms, business associate terms, security schedules, service levels, order forms, and other commercial terms may be governed by separate written agreements. If a separate written agreement applies, that agreement controls for the product or service covered by it.

By using the public website, submitting a form, or accessing public content, you agree to these Terms on behalf of yourself and, if you are acting for an organization, that organization.

1. Use of the website

You may use the public website only for lawful business, evaluation, and informational purposes. You must not use the website in a way that violates law, infringes rights, interferes with the website, compromises security, or harms Polytrace, its customers, or others.

Polytrace may update, suspend, restrict, or discontinue all or part of the public website at any time.

2. Product access and authority

Public website access does not grant access to the Polytrace product. Product access requires an authorized account, invitation, trial, order, or other approval. You are responsible for ensuring that anyone who requests product access for an organization has authority to do so.

If you submit information through the public website, you represent that the information is accurate and that you have the right to provide it.

3. Acceptable use

You must not, and must not help anyone else:

  • probe, scan, test, bypass, or compromise security or authentication controls without written authorization;
  • interfere with, overload, disrupt, or degrade the website, network, systems, or related infrastructure;
  • submit malware, harmful code, deceptive content, spam, or unlawful material;
  • scrape, crawl, copy, or harvest website content in a way that is abusive, unlawful, or inconsistent with posted instructions;
  • misrepresent your identity, affiliation, authority, or intent;
  • use the website to violate privacy, intellectual property, export control, sanctions, anti-corruption, anti-spam, or other applicable laws;
  • reverse engineer, decompile, or attempt to derive non-public source code, systems, models, or security controls except where law prohibits this restriction;
  • use public forms, contact routes, or demo routes for harassment, credential collection, phishing, or unsolicited bulk messaging.

4. Customer content and connected services

The Polytrace product can process communications, files, source metadata, attachments, calendar data, website data, storage objects, and derived outputs selected by customers. You are responsible for having all rights, permissions, notices, consents, and legal bases needed to connect sources, ingest content, invite users, publish outputs, and otherwise use the product.

You must not use Polytrace to collect or process content from Google, Microsoft, IMAP, storage, website, or other sources unless you are authorized to do so. You must not use Polytrace to access accounts, mailboxes, drives, sites, libraries, buckets, calendars, websites, or data beyond the scope approved by the account owner, administrator, customer, or applicable law.

Polytrace's processing of customer content is also governed by the applicable customer agreement and the Privacy Policy.

5. Runtime automation and auditability

Polytrace may include automated or semi-automated product capabilities such as extraction, classification, policy suggestions, risk scoring, workflow suggestions, or other customer-facing automation. These capabilities must operate through explicit application features and are subject to the product permissions, audit, provenance, and governance controls available in the service.

No public website statement grants any right to bypass product permissions, mutate raw source data, or perform unsupported automation.

6. Third-party services

The website and product may link to, interoperate with, or rely on third-party services such as Google APIs, Microsoft Graph, cloud hosting, analytics, billing, email delivery, support, infrastructure, and customer-configured source systems. Third-party services are governed by their own terms and policies.

Polytrace is not responsible for third-party services outside its control. You are responsible for complying with provider terms, account rules, administrator approvals, and consent requirements for any third-party service you connect or authorize.

7. Intellectual property

The website, software, product design, trademarks, logos, text, graphics, documentation, and other materials are owned by Polytrace or its licensors and are protected by intellectual property and other laws. Except for the limited right to view and use the public website for lawful business evaluation, no rights are granted unless expressly stated in a written agreement.

If you provide feedback, suggestions, ideas, or comments, Polytrace may use them without restriction or compensation, unless a separate written agreement says otherwise.

8. Confidentiality

Public website content is not confidential. Non-public product information, roadmap information, security information, pricing, demos, credentials, customer content, and similar information may be confidential under a separate agreement or under the circumstances of disclosure. You must protect confidential information you receive from Polytrace and use it only for the purpose for which it was provided.

9. Privacy

Polytrace handles personal information according to the Privacy Policy and uses cookies and similar technologies according to the Cookie Policy. By using the website or service, you acknowledge those policies.

10. Security reports

If you believe you found a security issue, contact Polytrace through the Contact page or at support@polytrace.com. Do not publicly disclose a vulnerability before Polytrace has had a reasonable opportunity to investigate and remediate it. Security testing must not access, modify, delete, exfiltrate, or disrupt data that does not belong to you.

11. Disclaimers

The public website and public content are provided on an "as is" and "as available" basis. Public content is for general information and evaluation only and is not legal, compliance, security, accounting, or professional advice. Polytrace does not warrant that the website will be uninterrupted, error-free, secure, or free from harmful components.

Product commitments, warranties, service levels, support obligations, data protection obligations, and security commitments are only those stated in the applicable written agreement.

12. Limitation of liability

To the maximum extent permitted by law, Polytrace and its affiliates, officers, employees, contractors, licensors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for lost profits, lost revenue, lost goodwill, business interruption, loss of data, or cost of substitute services arising from or related to the public website or these Terms.

To the maximum extent permitted by law, Polytrace's total liability for claims arising from or related to the public website or these Terms is limited to one hundred U.S. dollars (US$100). These limitations do not limit liability that cannot be limited by law or liability expressly governed by a separate written agreement.

13. Indemnity

You will defend, indemnify, and hold harmless Polytrace and its affiliates, officers, employees, contractors, licensors, and suppliers from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the website, violation of these Terms, violation of law, infringement or misappropriation of rights, or unauthorized submission or processing of data.

14. Suspension and enforcement

Polytrace may suspend, block, throttle, or terminate access to the website or public forms if it reasonably believes access violates these Terms, creates risk, threatens security, causes operational harm, violates law, or could expose Polytrace or others to liability.

Failure to enforce a provision is not a waiver. If a provision is found unenforceable, the remaining provisions remain in effect.

15. Changes to these Terms

Polytrace may update these Terms from time to time by posting an updated version on this page. The updated Terms apply to website use after the updated version is posted. Separate written agreements are changed only according to their own terms.

16. Governing law and disputes

If a separate written agreement applies, that agreement governs its own law, venue, and dispute terms. If no separate written agreement applies, these Terms and public website use are governed by the laws applicable at Polytrace's principal place of business, without regard to conflict-of-law rules. The parties consent to the exclusive courts located in that jurisdiction for disputes arising from the public website or these Terms, except that either party may seek injunctive or equitable relief in any court with proper jurisdiction.
